These Terms of Service ("Terms") form a binding agreement between you and Littale LLC, a New Mexico limited liability company ("Littale," "we," "us," or "our"), governing your access to and use of littale.com, app.littale.com, and all related features (collectively, the "Service"). By creating an account, purchasing a subscription, or otherwise using the Service, you agree to be bound by these Terms, our Privacy Policy, our Cookie Policy, and our Cancellation & Refund Policy, each of which is incorporated into these Terms by reference.
If you do not agree to these Terms, or if you lack the legal capacity to enter into this agreement, you must not access or use the Service.
1. Eligibility & Account Registration
- You must be at least 18 years old, or the age of legal majority in your jurisdiction, to create an account, hold a subscription, and manage billing on the Service. Accounts and payment activity must be performed by an adult.
- Children may participate in reading storybooks and completing Learning Quests only as permitted under Section 6 (Youth Safety) and our Privacy Policy — a child may not independently register an account for purposes of managing billing, uploading photographs, or providing personal information about themselves or others beyond what a supervising Authorized Adult permits.
- You must provide accurate, current registration information, verify your email address via one-time password (OTP), and keep your login credentials confidential. You are responsible for all activity that occurs under your account, and must notify us immediately at support@littale.com of any unauthorized access.
- You may register using a direct email/password sign-up or via Google OAuth, subject to Google's own terms.
2. Description of the Service
Littale is a software-as-a-service platform that allows users to generate personalized, AI-illustrated digital storybooks from an uploaded photograph and user-provided details, complete interactive Learning Quests linked to each story, share and read stories through the Open Library or private links, and order physical printed copies. Features are made available across Free and Premium subscription tiers as described in Section 5. We may add, modify, or discontinue features, and may adjust credit allocations or usage limits, at our discretion, in order to operate and improve the Service.
3. Photograph & Content Upload Warranties
- Rights you must have: By uploading a reference photograph or any other content, you represent and warrant that you own the rights to it, or that you are the parent, legal guardian, teacher, or other adult with legal authority over the person depicted, and that you have the right to submit it for processing as described in these Terms and our Privacy Policy.
- Prohibited uploads: You may not upload a photograph of any person, including a minor, for whom you do not have this authority. You may not use the Service to create deepfakes, non-consensual likenesses, face-swaps, voice impersonations, or any content depicting a real, identifiable public figure or celebrity without authorization.
- Non-realistic output only: The character generation feature is designed to produce stylized, non-photorealistic cartoon illustrations, not biometric or photorealistic likenesses.
- Handling of source photographs: Uploaded photographs are never displayed publicly and are permanently deleted no later than 30 days after upload, as described in our Privacy Policy.
4. Ownership & License to Generated Content
- As between you and Littale, you retain the rights you already hold in the photographs, names, and details you submit. Littale does not claim ownership over the specific story text, illustrations, or cartoon character generated from your inputs.
- Subject to your compliance with these Terms, we grant you a non-exclusive, worldwide, royalty-free license to use, download, share, and order physical prints of your generated storybooks for personal, non-commercial purposes, unless you have a separate written agreement with us permitting commercial use.
- You grant Littale a limited, non-exclusive, worldwide license to host, store, process, and display your generated content solely as necessary to operate the Service — for example, to render your storybook, run Learning Quests, and, if you choose to make a storybook public, display it in the Open Library as described in Section 6.
- We may remove any content, at our discretion, that we believe violates these Terms, infringes a third party's rights, or is otherwise unlawful or unsafe.
5. Subscription Plans, Credits & Billing
The Service is offered under the following tiers, each subject to change with reasonable notice: Free ($0/month — Open Library access, limited Learning Quests, reading and sharing of custom books); Premium Monthly ($12/month — 1 Book Creation Credit, 10 Image Regeneration Credits, full Learning Quests, PDF/art downloads, ad-free experience); and Premium Yearly ($115/year — 15 Book Creation Credits, 200 Image Regeneration Credits, and all Premium features).
- Credit mechanics: generating one complete storybook (one hero image, ten story-page illustrations, and two cover images) consumes one Book Credit. Regenerating any single illustration, hero image, or cover consumes one Image Credit. Supplemental Book Credits and Image Credits may be purchased separately as one-time Add-On packs.
- Merchant of Record: all payments, recurring billing, currency conversion, tax calculation, and invoicing are processed exclusively by our Merchant of Record, Stripe, Inc. ("Stripe"). By initiating a purchase, you authorize Stripe to charge your selected payment method for the applicable fees and taxes. We never receive or store your full card details.
- Automatic renewal: Premium subscriptions renew automatically at the end of each billing cycle (monthly or yearly) until cancelled. You may cancel automatic renewal at any time via your Account Settings dashboard; cancellation stops future billing but does not itself trigger a refund for past payments (see our Cancellation & Refund Policy).
- Continued access after cancellation: if you cancel without requesting a refund, your account retains Premium access until the end of the current prepaid billing cycle, after which it reverts to the Free tier.
- Refunds: all refund requests are governed exclusively by our separate Cancellation & Refund Policy, which describes our 15-day review window and credit-usage-based refund tiers. Refunds are reviewed manually and are not available through an automated dashboard button.
- Credit carry-forward: unused Book Credits and Image Credits carry forward from one billing cycle to the next — whether Monthly or Yearly, and including if you switch between Monthly and Yearly plans — for as long as your Premium subscription remains continuously active and renews without interruption.
- Forfeiture upon cancellation or non-renewal: the moment your Premium subscription lapses — whether because you cancel, a renewal payment fails, or you otherwise do not renew — any remaining Book Credits and Image Credits are immediately reduced to zero and permanently forfeited. This applies even if you purchase a new subscription later; forfeited credits are not restored or reinstated under a future subscription. To keep your accumulated credits, your subscription must remain active and renew without a gap.
6. Youth Safety, Classroom Use & Public/Private Sharing
- Only a verified adult — a parent, legal guardian, teacher, or other Authorized Adult — may create a storybook, upload a photograph, or provide a child's personal details, as described in our Privacy Policy.
- Premium Creators (including teachers) may share stories via a private, unique 32-character link. Students may read the Storybook via this link, but an active account is required to participate in the Learning Quests. If a student chooses to register a free account or sign in to save quest progress, the creator may view that student's quest answers, scores, and leaderboard rank, but never their raw Read Aloud audio recordings.
- Educators represent and warrant that they hold any necessary school, district, or parental authorization required to distribute storybooks and quest links to students.
- Public storybooks: making a storybook public requires your explicit, separate consent, and allows any visitor to read it, complete its Learning Quests, comment, rate it (1–5 stars), and appear on its dedicated leaderboard. Any user may download or, order a print of a public storybook.
- Private links: anyone holding a storybook's unique 32-character link can access it unless you disable access again via the storybook's "Allow Private Access" toggle. You are responsible for controlling who you share this link with.
7. Account, Content & Data Deletion
- Storybook deletion: executed from the storybook's settings panel, requires OTP verification, and is immediate, permanent, and unrecoverable.
- Character deletion: an unused character may be deleted at any time; a character in use by an active storybook must have that storybook deleted first. Character deletion is permanent.
- Account deletion: requires OTP verification and immediately and irreversibly forfeits any remaining subscription time, Book Credits, or Image Credits — these are not restored even if the account is later recovered. Deleted accounts may be restored within a 30-calendar-day recovery window by contacting support@littale.com from the registered email address; after 30 days, deletion is permanent.
8. Physical Print Orders (Powered by Lulu.com)
Physical printing and global delivery of hardcover or softcover storybooks are handled by a globally reputable third-party print-on-demand service provider, Lulu.com. When you place a physical order, you will be asked to provide shipping information — full name, email, phone number, address line 1, address line 2, city, state, zip/postal code, country, and whether the address is a home or office — which we store and transmit to Lulu.com to produce and ship your order. Ordering a physical copy requires acceptance of Lulu.com's own terms and privacy policy. The following terms will apply for using the service:
- All custom printing, binding, packaging, and international or domestic shipping will be fulfilled by our print-on-demand partner, Lulu Press, Inc. ("Lulu.com"), and its associated shipping carriers. Ordering a physical copy requires acceptance of Lulu.com's own terms and privacy policy.
- Because each printed book is a bespoke, print-on-demand item created from your specific content, orders cannot be cancelled, modified, or refunded for general dissatisfaction once sent to the Lulu.com production queue.
- Defect Resolution Protocols: if your physical order arrives with a manufacturing defect, binding error, missing pages, or shipping damage, you must submit clear photographic evidence to support@littale.com within 7 days of delivery; verified defective items will be reprinted and reshipped at no additional cost, as per Lulu's Return Policy.
9. Third-Party Services
The Service relies on and integrates with third-party providers, including Stripe (payments); one or more established third-party AI providers for content generation and safety filtering, which we do not publicly identify by name for security and operational reasons; Google LLC (Google OAuth for sign-in, and Google Analytics); Vercel, Inc. (frontend hosting and analytics); Amazon Web Services, Inc. (backend hosting, database, and storage); Cloudflare, Inc. (CDN, DNS, and security); Hostinger (transactional and support email delivery); Google AdSense and other advertising networks; and Lulu Press, Inc. (print fulfillment for physical orders). Your use of features that rely on these providers is also subject to each provider's own terms and policies. We are not responsible for the acts, omissions, downtime, or policies of these independent third parties.
10. Prohibited Conduct
You agree not to:
- Upload content you do not have the legal right to use, or content depicting a minor without proper authorization;
- Use the Service to generate deepfakes, non-consensual likenesses, voice impersonations, or unlawful, defamatory, obscene, or harmful content;
- Use automated scripts, bots, scrapers, or crawlers to access, harvest data from, or reverse-engineer the Service or any underlying third-party API;
- Attempt to bypass access or paywall controls, or access features or content without valid credits or a valid subscription;
- Upload malware, disruptive code, or attempt to interfere with the security or availability of our infrastructure;
- Infringe any third party's intellectual property, privacy, or other legal rights; or
- Violate any applicable law in connection with your use of the Service.
We maintain automated content-safety filters and a dedicated moderation process; violations may result in immediate content removal and permanent account termination. Verified copyright or inappropriate-content complaints submitted to support@littale.com are generally investigated and acted upon within 72 hours.
11. Communications
By maintaining an account, you consent to receive mandatory transactional emails (OTP codes, password resets, security notices, billing receipts, and support correspondence) as a condition of using the Service. You may separately opt out of promotional/marketing emails at any time via the unsubscribe link included in those messages.
12. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or completely secure, or that AI-generated content will be accurate, consistent, or free of unexpected variation. We are not responsible for outages, delays, or errors caused by third-party providers, including hosting, analytics, AI, payment, or print-fulfillment partners.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LITTALE LLC AND ITS OFFICERS, EMPLOYEES, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, REVENUE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO US THROUGH STRIPE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.
14. Indemnification
You agree to indemnify and hold harmless Littale LLC, its officers, employees, and service providers from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your content, or your violation of these Terms or any applicable law or third-party right.
15. Termination
You may stop using the Service and delete your account at any time as described in Section 7. We may suspend or terminate your access to the Service, with or without notice, if we reasonably believe you have violated these Terms, engaged in fraudulent or unlawful activity, or created risk or legal exposure for Littale or other users. Provisions of these Terms that by their nature should survive termination (including Sections 4, 9, 12, 13, 14, and 16) will survive.
16. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of New Mexico, USA, without regard to its conflict-of-laws principles, except where applicable consumer protection law requires the application of your local law. Any dispute arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the state or federal courts located in New Mexico, unless applicable law in your jurisdiction requires otherwise.
17. Changes to These Terms
We may update these Terms from time to time to reflect changes in our Service, legal requirements, or business practices. We will post the updated Terms on this page with a revised "Last Updated" date, and for material changes we will provide additional notice, such as a dashboard alert or email. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
18. General Provisions
If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect. Our failure to enforce any right or provision will not be considered a waiver of that right. These Terms, together with our Privacy Policy, Cookie Policy, and Cancellation & Refund Policy, constitute the entire agreement between you and Littale LLC regarding the Service.
